Abstract

In 2004, the Texas Supreme Court issued several decisions which did not involve an arbitration proceeding or award but pointedly implicated arbitration to justify enforcement of private agreements. These decisions from the Fifth Circuit and current state and federal legislative proposals will directly affect the construction law practice.
